All interested persons please take notice that a public hearing will be held by the Cleveland County Board of Commissioners pursuant to N.C.G.S. 158-7.1 on August 1, 2023, at 6:00 p.m. or shortly thereafter. The meeting will be held in the Commissioners Chambers on the Third Floor of the Cleveland County Administration Building, located at 311 East Marion Street in Shelby, North Carolina 28151.

The purpose of the public hearing is to hear the views of the public on the sale by the County of approximately 107 acres of land owned by the County, as further described below, to an entity for use in connection with “Project Sunrise” for the location of an industrial facility for the manufacturing of composite external insulation products for power transmission and distribution (the “Facility”) in Cleveland County. Subject to comments received at the public hearing, the Board of Commissioners intends to approve the sale. Specific details of the conveyance as are follows:

  • The interest to be conveyed is fee simple ownership of a site to be purchased from the County located in the vicinity of Farmville Road and consisting of approximately one hundred and seven (107) acres located east of Leadership Drive and described at Deed Book 1625, Page 163, Cleveland County Registry (for further reference see Cleveland County Tax Parcel Number 32196, PIN 2528520653) and that certain property described at Deed Book 1626, Page 1244, Cleveland County Registry (for further reference see Cleveland County Tax Parcel Number 61941, PIN 2528338005) (the “Property”).
  • The purchase price for the Property and all appurtenant rights shall be $22,500.00 per acre of land (prorated for any partial acres, and excluding any land dedicated for public use as part of any subdivision, and as such acreage is finally determined by a survey) (the “Purchase Price”).
  • The conveyance will be subject to the condition that within 270 days following closing, which may be extended due to Force Majeure (as defined in the Purchase Agreement between the parties), Purchaser shall commence vertical construction of a portion of the Facility. If Purchaser defaults by failing to commence vertical construction as required by the Purchase Agreement and fails to cure such default within sixty (60) days after receiving written notice of default from Seller, Seller may, in its sole discretion, repurchase the Property from Purchaser for the Purchase Price.

Before approving the purchase, the Commissioners shall (1) determine the average hourly wage to be paid to workers by the business to be located at the Property and (2) the fair market value of the interest, subject to the repurchase option described above.

All interested citizens are invited and urged to attend. Individuals who wish to address the Board during the public hearing shall register on the sign-up sheet, which will be available fifty (50) minutes prior to the start of the meeting and collected ten (10) minutes prior to the start of the meeting.
